Beta terms
These are the terms you accept in the product when you activate a beta key.
DRAFT: pending legal review. This text is a working draft, not reviewed legal advice.
This agreement is between the Portdeck project owner ("we") and the person or organization that holds a Portdeck private-beta license key ("you"). Accepting it in Portdeck is a condition of the key unlocking anything.
1. What the beta is
Portdeck is pre-release software. A beta license key unlocks the Pro and Enterprise features that exist in the build you run, for the term printed in the key, so that you can try them and tell us what you find. It is not a purchase and does not promise any feature, price, plan, schedule or support.
2. No warranty
The beta software and the key are provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose, merchantability, availability, security and non-infringement. We may change, break or remove features at any time. To the fullest extent the law allows, we are not liable for any loss or damage from using the beta, including lost data, downtime or lost profit.
3. Not for critical production
Do not run the beta where a failure would cause harm, loss of business or loss of data you cannot recover. Keep your own backups. Use it for evaluation and non-critical systems.
4. Do not redistribute
The license key is issued to you personally for the tester named in it. Do not share, publish or resell the key, and do not share the beta builds, the documentation or the agreement outside your organization without our written permission. The key stops working on its expiry date, and we may ask you to stop using it earlier.
5. Feedback welcome
We would like to hear what works and what does not. Feedback you send us (bug reports, ideas, logs you choose to share) may be used to improve Portdeck without obligation to you. Please do not include secrets or other people's personal data in it.
6. Data and telemetry
- Portdeck checks a license key offline. Nothing about the key is sent anywhere to verify it.
- The software does not report anything about your install back to us. It currently contains no telemetry. If that ever changes, it will be opt-in and announced first.
- We never collect age or precise location.
- This install records, in its own database, that you accepted this agreement: who accepted, when, and which version. It does not store the license key text in that record.
7. Ending the beta
Either side may end this agreement at any time. When the key expires or you remove it, the install returns to its trial or the Community plan. Nothing you have created is deleted or stopped by Portdeck because of that.
8. Changes to this text
If this agreement changes, Portdeck asks the key's holder to accept the new version before the key unlocks plan features again. Until then the install runs as it would without the key.
